What is Alternative Dispute Resolution and how can it solve conflicts?

< Back to Legal Insights

Alternative Dispute Resolution or ADR is the process of solving problems without needing to go through court proceedings. Here is our guide to help you understand further.

Going through a conflict with someone else is never a walk in the park, it can be a stressful and lengthy process. If you ever find yourself in a situation where issues can’t be resolved amicably between both parties, you may need to seek legal advice for a solution.

ADR can be a good solution to resolve disputes without needing to go through court.

There are four types of ADR that you can explore;

  • Mediation – where a qualified Mediator tries to help the parties reach a mutual resolution;
  • Arbitration – where an Arbitrator hears both sides of the arguments, collects evidence and decides on the outcome;
  • Negotiation – works on negotiating a compromise between parties; if instructed specialist solicitors can negotiate on behalf of people;
  • Conciliation – typically used in employment disputes, a conciliator will try to help the parties reach an agreement.

Whilst each type of ADR have their own advantages, the type used would be determined on a situational basis. Our expert dispute resolution solicitors can advise on the most appropriate method for you.

What are the benefits of using ADR?

When resolving a dispute, ADR can be more beneficial vs going to court and it can be a suitable resolution for most common disputes. Key benefits of ADR include:

  • Privacy
  • Cost-efficency
  • Less stressful
  • A quicker process
