The Information Commissioner’s Office (ICO) has updated its guidance on timescales for responding to data subject individual rights requests. The guidance makes clear that, when calculating the one-month period for response, the day of receipt is day one rather than the day after receipt.
Employers should have in place procedures to ensure requests are dealt with appropriately and that those responsible for dealing with requests are aware of the time limit (although the time limit may be extended by a further two months in certain circumstances where the requests are numerous and/or complex).
